SC upholds validity of sc/st amendment act 2018

A bench headed by Justice Arun Mishra said, a preliminary inquiry is not essential before lodging an FIR under the act nor is the approval of senior police officials.

  • The SC/ST Amendment Act 2018 was brought to nullify the effect of a Supreme Court ruling which had diluted the provisions of the stringent Act.

  • Earlier, on the 20th of March, 2018, taking note of rampant misuse of the stringent SC/ST Act, the top court ruled out the immediate arrest on any complaint filed under the law.

India-U.S relationship gains momentum in recent times

  • United States-India Strategic and Partnership Forum in Washington has said that bilateral trade between India and the US has got momentum in recent times and it is moving in favour of Washington. The group said that it is mainly due to the sudden increase in energy import by New Delhi that the trade got momentum. The forum is a top India-centric American trade and strategic advocacy group.

Mr Aghi said that even after the US withdrew India's privileges under Generalized System of Preferences, the export in that sector had not slowed down.

Solar orbiter blasts off to capture sun’s pole images

  • Europe and NASA's Solar Orbiter rocketed into space Sunday night on an unprecedented mission to capture the first pictures of the sun's elusive poles.

  • The $1.5 billion spacecraft will join NASA's Parker Solar Probe, launched 1 1/2 years ago, in coming perilously close to the sun in order to unveil its secrets.

  • While Solar Orbiter won't venture close enough to penetrate the sun's corona, or crown-like outer atmosphere, like Parker, it will maneuver into a unique out-of-plane orbit that will take it over both poles, never photographed before. Together with powerful ground observatories, the sun-staring space duo will be like an orchestra, according to Gunther Hasinger, the European Space Agency's science director.

  • Solar Orbiter -a boxy 4,000-pound (1,800-kilogram) spacecraft with spindly instrument booms and antennas will swing past Venus in December and again next year, and then past Earth, using the planets' gravity to alter its path. Full science operations will begin in late 2021, with the first close solar encounter in 2022 and more every six months.

  • At its closest approach, Solar Orbiter will come within 26 million miles (42 million kilometers) of the sun, well within the orbit of Mercury.

Centre to host another set of foreign diplomats to Jammu & Kashmir

  • The government is making preparations to organise a second visit of diplomats, including several European Ambassadors, to Srinagar and Jammu next week, sources confirmed here.

  • Unlike the last visit in January, when European Union (EU) members declined to travel and asked to be sent as a combined group of 27 members, this time, several members of the EU have agreed, sources said.

  • “While all the Ambassadors expressed their concerns about issues like political detentions and Internet restrictions, they were able to see that there was normalcy on the roads, and the entire Union Territory is not under lockdown as they had expected,” the source added.

  • Diplomatic sources said negotiations over the scope and schedule of the proposed visit have been on for the past month, and had run into issues over specific demands by the European diplomats to meet detained former Chief Ministers Mehbooba Mufti, Farooq Abdullah and Omar Abdullah.

RajyaSabha approves FDI bill on financial services and critical infrastructure

  • Several RajyaSabha members, cutting across party lines, today supported a private member’s bill, which seeks to set up a committee to scrutinise foreign investments in financial services, critical infrastructure and technology sectors having bearing on national security.

  • Members hailing from the BJP, the Congress and other parties raised concerns over data security and said it was an issue of national security and that there was a need to ensure that foreign direct investments in sectors such as financial services are scrutinised.

  • The bill was moved by NarendraJadhav in December last year. Participating in the debate on the bill, BJP member Shiv PratapShukla said that in the current scenario, FDI is necessary for the growth of the economy, but it should not be above national security concerns. Anil Desai of the Shiv Sena said, there should be a high- powered committee to scrutinise such FDI proposals.

Government to enhance independence and accountability of auditors

  • The government has proposed significant amendments to existing regulations to enhance independence and accountability of auditors.

  • Against the backdrop of instances of many auditors and auditing entities coming under the regulatory lens for alleged misdoings, the government has come out with a consultation paper on proposed legal changes regarding audit.

  • A significant topic in the paper is about economic concentration of the “Big Four” audit firms and the need to build the capacity of home-grown Indian firms that may need to be at par with global organisations in terms of audit procedures and manpower capacity, among other factors.

  • The paper has sought comments on whether the number of audits under one audit firm or auditor needs to be reduced. Inspection of audit engagements and developing a ‘Composite Audit Quality Index’ to improve accountability of auditors and audit firms are among other proposals.

Finance ministry claims no shift in policy from Make in India to assemble in India

  • Finance Minister NirmalaSitharaman today said that there is no shift in government's priority from Make in India to Assemble in India and that both these policies will provide impetus to capacity building and more employment opportunities in the coming years.

  • She said, any concern that the Government is only keen about Assemble in India over Make in India is a complete misconception. The Finance Minister was addressing members from the Industry sector at an event organized by CII in New Delhi today.

  • Ms.Sitharaman asserted that Assemble in India is an avenue that was not explored to its full potential till date by any government. She assured that the government is always exploring more and better ways of promoting entrepreneurship and wealth creation.

  • Economic Survey tabled in parliament last Friday pointed that Assemble in India is likely to create 80 million jobs in the next 10 years. The Finance Minister also said that any duty hike in the Budget 2020-21 is not a method of protectionism but a mechanism to avoid India being a dumping ground for products that can be indigenously produced.

Pakistan to go for public hanging of child molesters

  • Pakistan’s Parliament passed a resolution on Friday calling for the public hanging of convicted child killers and rapists, drawing a quick backlash from human rights organisations.

  • The non-binding resolution follows a spate of high-profile child sex-abuse cases that have provoked outrage and riots across Pakistan in recent years.

  • Child killers and rapists “should not only be given the death penalty by hanging, but they should be hanged publicly,” said Ali Muhammad Khan, Pakistan's Parliamentary Affairs Minister, who presented the resolution in the national assembly, or lower house.

  • Though a majority of lawmakers approved the resolution, Human Rights Minister ShireenMazari stressed it was not sponsored by the government. The resolution “on public hangings was across party lines and not a govt-sponsored resolution but an individual act. Many of us oppose it our Ministry opposes this,” Ms.Mazari tweeted.

  • Child sexual abuses are rampant in Pakistan. In October 2018, authorities hanged a child rapist in an infamous case in Kasur, near Lahore, that sparked nationwide protests. In that case, a six-year-old was raped and murdered by a 24-year-old man.

India’s leopard population faces catastrophic declines

  • India’s leopard population may be only a tenth of what it was a little over a century ago, experiencing catastrophic declines due to human pressures. Given the threats the animal faces – conflicts with humans, poaching, habitat loss and availability of prey – a group of scientists with new insights on loss of leopard abundance say that an initiative similar to ‘Project Tiger’ is required for the cat.

  • The leopard population, perceived to be stable due to broad geographic distribution, suffered a possibly human-induced population decline of 75% to 90% between 120 and 200 years ago, the scientists propose, in a paper titled, ‘Genetic analyses reveal population structure and recent decline in leopards (Pantherapardusfusca) across the Indian subcontinent’ published in the journal PeerJ – Life and Environment on Friday.

  • Scientists from the Centre for Wildlife Studies (CWS India) and the Wildlife Institute of India (WII) used genetic data from leopards from across the subcontinent to investigate population structure and patterns of decline. They probed the demographic history of each sub-population and compared genetic decline analyses with countrywide local extinction probabilities.

  • The authors argue that the population decline in a species seen as wide-ranging and locally abundant suggest that leopards demand attention just like tigers.

  • Authors Supriya Bhatt, SuvankarBiswas, BivashPandav and SamratMondol from WII, and Krithi K. Karanth from CWS India, collected faecal samples from the Terai-Arc landscape of northern India and identified 56 individuals using a panel of 13 microsatellite markers, and merged this data with those of 143 other leopards.

  • Genetic analyses showed four sub-populations — Western Ghats, Deccan Plateau-Semi Arid, Shivalik and Terai region with high genetic variation.

CJI pushes for mandatory pre-litigation mediation in cases

  • Chief justice of India S ABobde has stressed on the need to have a comprehensive law on making pre-litigation mediation mandatory. He said it would ensure efficiency and reduce the time of pendency for parties as well as courts.

  • Speaking at the third International Conference organised by the Indian Council of Arbitration (ICA ) and Federation of Indian Chamber of Commerce and Industry (FICCI) yesterday, Justice Bobde said the time is ripe to devise such a law.

  • The Chief Justice of India said, though arbitration is the most preferred mode of privately resolving a big range of disputes today, it is done at the cost of mediation and conciliation which is faster and less expensive.

Odisha plans for developmental projects in Naxal affected areas

  • After the security forces made their presence felt in SwabhimanAnchal, a stronghold of the CPI (Maoist), in Odisha’sMalkangiri district, the State government has lined up development projects, including livelihood programmes and irrigation facilities, besides critical road networks for the region.

  • SwabhimanAnchal remained outside the ambit of development for years due to its remoteness, poor connectivity, hilly and inhospitable terrain and above all the presence of outlawed left wing extremists.

  • The administration has decided to promote turmeric cultivation by replacing prohibited cannabis cultivation, while all nine gram panchayats will be covered under integrated farming.

  • Avoiding top-down approach in development, the government has taken a decision to listen to locals who understand the ground situation better than others. A five-day workshop has been proposed at the Gopabandhu Academy of Administration at Bhubaneswar.

  • The government will emulate the model of Maharashtra where CFR has been granted in an expeditious manner for making tribals partners in development. People of SwabhimanAnchal are likely to be taken to Maharashtra for a field visit.

  • For the overall development, a plan has been mooted to install lift irrigation points alongside the Balimela reservoir basin. The administration proposed to provide an 11-kv power line exclusively for irrigation projects.

Textile industries urged to take advantage of chinese export crisis

  • With several businesses said to be affected in China due to the coronavirus, the Indian textile and clothing sector should seize the opportunity in global trade, T. Rajkumar, chairman of the Confederation of Indian Textile Industry, said.

  • “We expect China will take 3-4 more months to return to normalcy [following the outbreak of the coronavirus]. Indian textile and clothing exporters should be aggressive and tap overseas orders that will shift from China,” he told mediapersons here.

  • On the announcements in the Union Budget, Mr.Rajkumar said that abolition of anti-dumping duty on PTA would lead to 20-25% of textile mills switching over to synthetic yarn production from cotton. The anti-dumping duty on PTA was $26 to $160 a tonne depending on the country from where it was imported.

  • With removal of the anti-dumping duty, the raw material for production of MMF (man-made fibre) will be available at international price. At present, cotton yarn production in India is higher than synthetic yarn. Several mills will move to MMF now, he said.

  • Textile Secretary Ravi Capoor will visit Coimbatore on February 12-13 and hold meetings with representatives of textile associations from the southern State, Mr.Rajkumar said.

Top airports hit due to capacity issues

  • Congestion at India’s top four airports Delhi, Mumbai, Bengaluru and Hyderabad will continue in the medium term as the number of air passengers has seen a rise despite the slowdown in the economy and closure of Jet Airways, Crisil Ratings said in a study.

  • These four airports handle more than half of air passenger traffic in India and currently operate at over 130% of capacity utilisation. With healthy traffic growth projected in the near future, this operating rate is expected to rise further in next 12 months, it said.

  • This, despite a ₹38,000-crore capex being undertaken by operators between 2020 and 2024. The capex, the highest to be incurred in any continuous five-year period, is largely debt-funded.

  • High utilisation will ride on pent-up demand (accumulated in 2019 as traffic was impacted with the grounding of Jet Airways) and one-off issues with new aircraft of certain airlines. Further impetus will also come from improving connectivity to smaller cities and reducing fare difference between air and rail, Crisil Ratings said.

China to use AI data to fight against virus

  • A man who had travelled to Wuhan -- the central city at the heart of China's coronavirus crisis -- was surprised when police showed up at his door after he returned home, asking to check his temperature. The man, who had quarantined himself at home in Nanjing, eastern Jiangsu province, said he had not told anyone about his recent trip to the city.

  • But by trawling through travel data from Wuhan, local authorities were able to identify him and dispatch officers to his home last week, according to a newspaper article posted by the Nanjing government.

  • As Chinese authorities race to contain the spread of a new virus, which has infected more than 34,000 people and killed more than 700 in China, Beijing is turning to a familiar set of tools to find and prevent potential infections: data tracking and artificial intelligence.

  • "Use big data technology to track, screen priority (cases), and effectively forecast the development of the epidemic in real time," China's National Health Commission (NHC) told local governments in an online statement Tuesday.

  • "Strengthen the information link between... public security and transportation, and other departments," it said, urging them to share train, flight, communication, and medical data.

  • Besides fever detection, Chinese tech firms have raced to develop a wide variety of services to help with epidemic control efforts, from preparing drone deliveries of medical supplies to mapping the spread of the virus from Wuhan.

  • In Beijing, some neighbourhoods are prompting residents to scan a QR code to fill out personal details, such as their phone number and hometown address.

  • One form also prompted participants to fill out details on their mode of transport, such as their licence plate or flight number, if they had travelled.

Scientists map Basmati rice genome

  • Scientists have mapped the complete genome of two basmati rice varieties, including one that is drought-tolerant and resistant to bacterial disease. The findings, published in the journal Genome Biology, also show that basmati rice is a hybrid of two other rice groups.

  • Despite the economic and cultural importance of basmati and related aromatic rice varieties, their evolutionary history is not fully understood, the researchers said.

  • The researchers focused on two basmati rice varieties: Basmati 334 from Pakistan, known to be drought tolerant and resistant to rice-killing bacterial blight, and Dom Sufid from Iran, an aromatic long-grain rice that is one of the most expensive on the market.

  • Most genetic material in basmati comes from japonica —a rice group found in East Asia — followed by the rice group aus found in Bangladesh.

  • The researchers aim to work with the scientific and rice breeding communities to identify important genes, see what makes the basmati group unique, and even develop molecular markers to help breed new varieties.

SC asserts reservation in promotion in public posts not part of fundamental rights

  • Reservation in promotion in public posts cannot be claimed as a fundamental right, the Supreme Court has reiterated in a judgment.

  • “There is no doubt that the State government is not bound to make reservation. There is no fundamental right which inheres in an individual to claim reservation in promotions. No mandamus can be issued by the court directing the State government to provide reservation,” the court observed.

  • Citing Constitution Bench precedents that had settled the law, the court said Articles 16 (4) and 16 (4-A) of the Constitution did not confer individuals with a fundamental right to claim reservation in promotion.

  • “It is a settled law that the State government cannot be directed to provide reservation for appointment in public posts. Similarly, the State is not bound to make reservation for Scheduled Castes and Scheduled Tribes in matters of promotions,” the court explained.

Farmers group wants agri and dairy products out of U.S trade talks

  • Farmers groups and lobbies, which successfully protested the agricultural and dairy free trade provisions of the Regional Comprehensive Economic Partnership (RCEP) leading to India pulling out of those talks, are now urging the Centre to ensure that agricultural products stay out of the ongoing Indo-U.S. trade negotiations as well.

  • Reports suggest that with U.S. President Donald Trump set to visit India later this month, Amercian negotiators are pushing hard for the removal of tariff and non-tariff barriers to facilitate access to the Indian market for major crops including corn, cotton, soybean, wheat and nuts.

  • The U.S. is also keen on reaching a deal to open up the Indian dairy market, which had been hindered by the fact that the U.S. cattle feed often includes non-vegetarian elements.

  • Indian farm lobbies worry that this could have a disastrous impact on domestic farmers, already facing a struggle to get remunerative prices for their produce.

  • The import of genetically modified crops is also a thorny issue. “Most of the U.S. cotton, soy, corn is GM. While Indian farmers also grow GM cotton, India is yet to allow any GM food crop to be grown here. There are concerns about bio-safety,” said AfsarJafri, an expert on agricultural trade issues.

WestBengal develops arsenic resistant rice

  • Researchers have developed and commercialised a rice variety that is resistant to arsenic. Several studies have shown that arsenic from groundwater and the soil can enter the food chain through paddy.

  • West Bengal is among the States with the highest concentration of arsenic in groundwater, with 83 blocks across seven districts having higher arsenic levels than permissible limits.

  • The new rice variety, Muktoshri — also called IET 21845 — was developed jointly by the Rice Research Station at Chinsurah, coming under West Bengal’s Agriculture Department and the National Botanical Research Institute, Lucknow, over several years. A gazette notification for the commercial use of Muktoshri was issued by West Bengal last year.

  • The work on developing the variety started in 2006 and by 2013 the scientists were successful. Pradip Kumar Das, a farmer at Birnagar in Nadia district who cultivated the variety on over four hectares (30 bighas), said that the yield was satisfactory, despite a dry spell.

  • According to the World Health Organization, long-term exposure to arsenic, mainly through drinking water and food, can lead to poisoning. Skin lesions and skin cancer are the most characteristic effects.
